These Website Use Terms (hereinafter – Terms) are an integral part of the goods/service purchase agreement and define the Buyer's and Seller's rights and obligations, the terms and conditions of Goods delivery, the procedure for order cancellation and Goods return terms, refund conditions, and dispute resolution terms.

The Seller has the right to change, correct, or supplement the Terms at any time in accordance with the requirements stipulated by legal acts. Such changes become effective upon their publication on the Website.

The Seller has the right to change the prices indicated on the Website and/or create new paid services at its discretion at any time.

The contract between the Buyer and the Seller is considered concluded from the moment the Client, having selected the Goods, placed them in their shopping cart, specified the delivery address, and familiarized themselves with the terms, marks "I agree to the terms of use" in the order confirmation window.

Order confirmation is sent to the Client's specified email address.

General Provisions

If a consumer purchases goods/services through the website, such a mutual agreement is considered a Distance Contract and is subject to the legal norms of the Republic of Latvia regulating distance contracts, including, but not limited to, the Republic of Latvia "Consumer Rights Protection Law", the Republic of Latvia Cabinet of Ministers Regulations "Regulations on Distance Contracts", etc.

Making Purchases

The prices and specifications of products sold in the online store are indicated in the product description. To place an order, add the desired products to the shopping cart. Fill in all the necessary fields and choose the most suitable delivery method. The total cost of the order, including delivery, will then be displayed on the screen. Complete the purchase payment to finalize the order.

Payment Terms

The currency for payments on the website is Euro.

Purchases can be paid for using the following payment methods: Payment methods provided by the Klix (Citadele) payment platform:

  • Latvian internet banking payments: Swedbank, SEB, Citadele, and Luminor;
  • Visa/Mastercard card payments.

NB! When using the internet banking payment method, confirm your order and click on the "Return to merchant" button.

Personal data required for payments is transferred to the licensed payment institution Klix (Citadele).

The contract comes into force upon successful payment to the online store's bank account. If, for any reason, the order cannot be fulfilled, the Buyer will be informed, and the paid amount will be refunded as soon as possible, but no later than within 14 days after receiving the notification.

Delivery Terms

When placing an order, the Client can choose the delivery method:

  • Delivery via Omniva parcel lockers throughout Latvia: - €3.50

Delivery of goods via courier and/or parcel lockers is carried out within 1-2 days from the receipt of payment for the goods and the Client being sent an email confirmation that the order has been received.

Goods delivery costs are not included in the indicated Goods price. To find out the exact delivery costs of the order, place all Goods in the virtual cart and go to "Cart". When choosing the delivery location, the system will indicate the exact delivery costs of the order.

If an order contains several Goods and they are not delivered simultaneously, with prior notification to the Client, a separate fee will be charged for each delivery.

The Client makes the order payment with a bank payment card.

The Seller undertakes to deliver the Goods to the Client, observing the delivery terms specified in the Goods descriptions. If the delivery of goods is delayed due to unforeseen circumstances beyond the Seller's control, or due to circumstances dependent on the Seller, the Seller undertakes to immediately contact the Client and coordinate all matters regarding Goods delivery.

In cases where the Client, upon receiving the Goods, notices that the shipment does not contain the correct Goods or the Goods are not the correct size, color, or there are other discrepancies, the Client must immediately inform the Seller.

Right of Withdrawal

The Buyer has the right to withdraw from the purchase within 14 calendar days from the moment of receiving the Goods. The right of withdrawal is not applicable if the Buyer is a legal entity.

To exercise the 14-day right of withdrawal, the product packaging must not be opened or used; the consumer is responsible for maintaining the quality and safety of the product during the exercise of the right of withdrawal. If the goods are used inappropriately or damaged, handled negligently during use, or instructions are not followed, if the original packaging of the goods is lost, or if its packaging is significantly damaged, the online store has the right to reduce the refundable amount in accordance with the decrease in the value of the goods.

To exercise the right of withdrawal, you must contact the seller by sending a message to the email address info@ugunsakmens.lv within 14 days of receiving the goods. The Buyer bears the cost of returning the goods, except in cases where the reason for the return is that the item does not match the order (e.g., incorrect or damaged item).

The Buyer's obligation is to return the Goods to the Seller without delay, but no later than 14 days after sending the withdrawal form to the online store. After receiving the returned goods, the online store will immediately, but no later than within 14 days, refund all payments received from the buyer based on the Distance Contract. The refund will be made using the same payment method that the client used for the transaction.

The Seller has the right to withhold payment until the Goods have been received from the Buyer or proof of return of the goods has been provided. If the buyer has chosen a shipping method other than the cheapest shipping method offered by the online store, the online store is not obliged to compensate for the excess shipping costs.

The online store is not responsible for delays in performance or non-performance of obligations, or other types of non-performance, which have arisen due to circumstances and obstacles beyond the online store's reasonable control.

The online store reserves the right to refuse to sell goods and demand their return from the Buyer if the price indicated in the online store is significantly lower than its market price due to an error.

Consumer Rights Regarding Non-Conforming Goods

The online store is responsible for non-conformity of goods sold to the Buyer with the contract terms or for defects that occurred within 6 months after the goods delivery date to the client, or were present at the time of delivery, if such an assumption does not contradict the nature of the item or the defect. The Buyer must inform the Seller about the non-conformity of the goods immediately, within 14 days of its detection, i.e., submit a complaint. The Buyer can submit a complaint by contacting the online store at info@ugunsakmens.lv.

The online store is not responsible for defects that occurred after the delivery of the goods to the Buyer. If the purchased goods have defects for which the Seller is responsible, the Buyer has the right to demand the elimination of the goods' defects or exchange for new goods free of charge.

If the goods cannot be repaired or replaced, the Seller will refund to the Buyer all payments provided for in the Distance Contract. The Seller will provide a written response to the consumer's complaint within 15 days.

Processing of Buyer's Personal Data

The online store processes only the personal data that the buyer has entered when ordering goods, such as name, surname, email, phone number, delivery address, etc.

The online store transfers personal data to the transport service provider(s) to ensure the delivery of goods.

If you have explicitly agreed to receive our marketing communications, including newsletters, we may contact you from time to time by sending information about our services and the latest offers. For this purpose, we may process your email address, which you provided when signing up for marketing communications. The Buyer has the option to unsubscribe from marketing communications by notifying us at info@ugunsakmens.lv.

Dispute Resolution Procedure

In matters not covered by these terms and conditions, the Buyer and Seller undertake to comply with the regulatory acts in force in the Republic of Latvia.

The parties shall resolve all disputes arising between the Seller and the Buyer through mutual negotiations or correspondence. If the dispute cannot be resolved through negotiations or correspondence, the parties shall resolve the dispute in a court of the Republic of Latvia, observing the regulatory acts of the Republic of Latvia. Disputes between the Buyer (consumer) and the Seller can be submitted for resolution to the Consumer Rights Protection Centre or a court of the Republic of Latvia.

The Buyer also has the right to turn to European Union dispute resolution bodies.
